National Credit Union Administration to Start Regulatory Makeover

On June 16, 2025, Nacha placed financial institutions (FIs) on high alert of a new enforcement approach Have you ever reviewed a rule or regulation and thought, “This is outdated, unnecessary and overly burdensome”? Good news, so does the NCUA, and they are doing something about it!

In July of this year the NCUA announced plans to review agency regulations to better align with the federal government’s commitment to efficiency and help reduce the regulatory burden on credit unions. This review will be conducted over a 2-year time period and the NCUA has divided the regulations into the following ten categories:

  • Applications and Reporting;
  • Powers and Activities;
  • Agency Programs;
  • Capital;
  • Consumer Protection;
  • Corporate Credit Unions;
  • Directors, Officers, and Employees;
  • Anti-Money Laundering and Bank Secrecy Act;
  • Rules of Procedure; and
  • Safety and Soundness.

Once the reviews have been completed the NCUA will publish four Federal Register documents that will have a comment period of 90 days for credit unions to respond and provide feedback. Credit unions should make sure to take the time to review all the changes and provide any feedback you feel would be helpful in favor or against the changes. Below are a few helpful tips to consider when writing a response.

  • Be specific. Make sure that you clearly name the specific rule, section, or issue you are addressing in the proposed regulation to change. It is important to call out page numbers or any other identifiers that will make it helpful for the agency staff to review.
  • Be concise and clear. Use unambiguous language and make sure to avoid using jargon. Avoid technical terms that agency staff may not be familiar with.
  • Provide supporting evidence. Make sure to back up your argument with data, examples, and any other relevant experience.
  • Focus on the NCUA’s needs. Your feedback should address the agency’s goals and concerns and how your changes or recommendations align with their mission and goals.
  • Offer solutions. Make modifications and alternatives to the regulation that show how the changes could provide a better outcome.
  • Be respectful. When expressing concerns make sure to be professional and helpful in your feedback.
  • Follow instructions. Make sure that you are following the guidelines and formatting that is required by the agency when submitting your comments.

These are just a few helpful tips that you can use when submitting a comment. By doing this you will be able to effectively communicate with the NCUA and other regulatory agencies.

Make sure to keep an eye out over the next two years for updates of when the Federal Register documents will be available for review and comment.
