NV Legal Protections Triggered by Government Shutdown

As of October 1, 2025, the federal government shutdown has activated special legal protections in Nevada affecting residential foreclosures, vehicle repossessions, and evictions. Below is a summary of the key provisions:

NRS 40.4395: Limitations on Foreclosure Sales Involving Shutdown

  • Prohibits foreclosure sales on residential properties of federal, tribal, or state workers (including their household members or landlords) during a shutdown and for 90 days after it ends.
  • Borrowers must provide proof of eligible status.
  • Courts may stay judicial foreclosure proceedings or adjust the terms of any obligation(s) secured by a residential mortgage loan to preserve the interest of the parties unless the borrower’s ability to pay is not materially affected by the shutdown.
  • A person who “knowingly violates” these provisions is guilty of a misdemeanor and may be liable for actual damages, attorney’s fees, and costs (exception for trustees).

NRS 482.5165: Repossession of Vehicles of Certain Persons Prohibited During Governmental Shutdown

  • Prohibited from the start of a shutdown through 30 days after it ends for vehicles owned by eligible federal, state, and tribal workers, their household members, or landlords.
  • Proof of eligible status is required.
  • A person who “knowingly repossesses” is guilty of a misdemeanor and may be liable for actual damages, attorney’s fees and costs.

NRS 40.251 Subsection 3 and 4: Evictions During Shutdown

  • Tenants who are federal, tribal, or state workers—or household members of such workers—may remain in possession during a shutdown and for 30 days after it ends.
  • A written request and proof of eligibility are required.

NRS 118A.315: Petition by Landlord for Relief from Certain Requirements Relating to Shutdown

  • If a shutdown lasts 30+ days, landlords may petition the court for relief if compliance creates undue hardship (e.g., mortgage obligations, risk of foreclosure, or other financial strain).
  • Courts may modify or terminate the lease in such cases.
