A federal appeals court granted an immediate stay to the reinstatement of dismissed National Credit Union Administration (NCUA) Board Members Todd Harper and Tanya Otsuka late Friday, pending the outcome of the appeal filed by President Donald Trump’s administration.
A federal judge had ruled Tuesday last week that Trump’s dismissal of Harper and Otsuka was unlawful and counter to congressional intent. The administration filed its appeal later that evening.
Tuesday’s ruling reinstated Harper and Otsuka to the board immediately, and the two attended Thursday’s board meeting, but the stay now keeps them both off the board until the appeals process concludes.
The California Credit Union League, Nevada’s Credit Unions, and America’s Credit Unions firmly supports a fully staffed, three-member NCUA board so the agency can effectively fulfill its independent oversight mission. The leagues respect the judicial process and will continue to closely monitor the appeals proceedings as they move forward.
In the meantime, the leagues remain actively engaged with NCUA leadership to ensure the agency continues to support credit unions and can facilitate the financial success of the members they serve.
Appellees must file a response to the emergency motion for stay pending appeal by August 4, and a reply is due August 11.
